Agreement between customer and aa holidays
Welcome to the aa holidays accommodation and flight booking portal ("the booking engine").This booking engine is provided solely to assist customers to make legitimate reservations through the aa holidays server to enabled accommodation facilities and transacting business with accommodation and leisure suppliers. The term "user" and/or "you" and/or "your" refers to the customer using the aa holidays booking engine to make a reservation.
This booking engine is offered to you conditional upon your acceptance without modification of all the terms, conditions, and notices set forth below (collectively, the "agreement"). By accessing or using aa holidays in any manner, you agree to be bound by the agreement. Please read the agreement carefully. If you do not accept all of these terms and conditions, please do not use aa holidays. Be sure to return to this page periodically to review the most current version of the agreement. We reserve the right at any time, at our sole discretion, to change or otherwise modify the agreement without prior notice, and your continued access or use of aa holidays signifies your acceptance of the updated or modified agreement.

Limitation of liability
aa Holidaysassumes no responsibility for, and shall not be liable for, any damage to your computer equipment or other property on account of your access to, use of, or browsing in this site or your downloading of any materials, data, text, images, video or audio from the site. In no event shall aa Holidays or any of its third party suppliers be liable for any injury, loss, claim, damage, or any special, exemplary, punitive, direct, indirect, incidental or consequential damages of any kind (including, but not limited to lost profits or lost savings), whether based in contract, tort, strict liability, equity or otherwise, which arise out of or are in any way connected with (i) any use of this site or content found herein, (ii) any failure or delay (including, but not limited to the use of or inability to use any component of this site for reservations or ticketing), or (iii) the performance or non performance byaa Holidaysor any of its third party suppliers, including, but not limited to, non performance resulting from bankruptcy, reorganization, insolvency, dissolution or liquidation even if such party has been advised of the possibility of damages to such parties or any other party.
The third party suppliers providing travel or other services on this site are independent contractors and not agents or employees of aa Holidays. Aa Holidays is not liable for the unintentional or intentional acts, errors, omissions, representations, warranties, breaches or negligence of any such third party suppliers or agents of third party suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom.

Use of the aa holidays booking engine
As a condition of your use of aa holidays, you warrant that (i) you are at least 18 years of age, (ii) you possess the legal authority to create a binding legal obligation, (iii) you will use aa holidays in accordance with this agreement, (iv) you will only use this website to make legitimate reservations for you or for another person for whom you are legally authorized to act, (v) all information supplied by you to aa holidays is true, accurate, current and complete, and (vi) if you have a aa holidays account, you will safeguard your account information and will supervise and be completely responsible for any use of your account by anyone other than you. We retain the right at our sole discretion to deny access to anyone to aa holidays and the services we offer, at any time and for any reason, including, but not limited to, for violation of this agreement. You further agree that if you believe your account password has been compromised in any way, you will change your password details under your profile. You are responsible for any misuse or compromise made to your account. You agree that if any security violations are, in the sole and exclusive opinion for aa holidays, believed to have occurred in association with your account, aa holidays has the right to suspend all access to the account pending an investigation and resolution thereof to the satisfaction of aa holidays in its sole and absolute discretion.

Travel documents
It is the responsibility of each passenger to ensure that they are in possession of the correct documentation prior to departure. Aa holidays shall not accept responsibility for any consequences of any nature whatsoever, arising from the passenger failing to ensure that he/she has complied with the necessary health/passport/visa/re-entry permit requirements. Passports must be valid for a minimum of 6 months after your intended return date.

Aa Holidaysshall have no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure or other causes beyond its direct control, and shall have no responsibility for any additional expense, omissions, delays, re-routing or acts of any government or authority.
If, notwithstanding the foregoing, aa Holidaysor any third party supplier should be found liable for any loss or damage which arises out of or is in any way connected with any of the above described functions or uses of this site or its content, the liability of aa Holidays and the third party suppliers shall in no event exceed, in the aggregate, the total amount paid to aa Holidays in connection therewith. Some states or jurisdictions, to the extent their law might be deemed to apply notwithstanding the selection of south african law as described below, do not allow limitation of liability, so the foregoing limitation may not apply to you.

Travel insurance
Passengers are responsible for their own insurance and aa holidays will not be liable in the event of a passenger failing to take adequate insurance cover. Tour participants are accordingly strongly advised to take out travel insurance covering personal accident, medical expenses, emergency repatriation, baggage loss and loss of funds through cancellation or curtailment. All sporting activities undertaken by passengers are of their own choice and at their own risk. Aa holidays shall not be responsible for any accidents which may occur.

Prohibited activities
The content and information on aa holidays (including, but not limited to, price and availability of services), as well as the infrastructure used to provide such content and information, is proprietary to aa holidays or its suppliers and providers. While you may make limited copies of your travel itinerary (and related documents) for travel or services booked through aa holidays, you agree not to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from or through aa holidays. Additionally, you agree not to:
i.Make any speculative, false, or fraudulent reservation or any reservation in anticipation of demand.
ii.Access, monitor or copy any content or information off aa holidays using any automated means or any manual process for any purpose without our express written permission.
iii.Violate the restrictions on aa holidays or bypass or circumvent other measures employed to prevent or limit access to aa holidays.
iv.Take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure.
v.Deep-link to any portion of aa holidays for any purpose without our express written permission
vi.Incorporate any part of aa holidays into any other booking engine without our prior written authorization.
Cancellation fees and unused services
All bookings are non-refundable/non-transferable. In the event of a cancellation, the full cancellation fees will be imposed: No refunds will be considered on partially unused hotel accommodation, flights or car rentals.

Backup of data
Your use of the services provided for by aa holidays is at your sole risk. Aa holidays is not responsible for booking data or account configuration data residing on our servers. Any storage of such is strictly for the aa holidays user's convenience, and you recognize your obligation to maintain your sales and order data on your own computer systems.
You specifically agree that aa holidays is not responsible for storage of booking data of any type whatsoever for any amount of time. You acknowledge that aa holidays may establish general practices and limits concerning use of the booking engine, including without limitation the maximum number of days that a database or organization will be retained by the booking engine if unused. You agree that aa holidays has no responsibility or liability for the deletion or failure to store any information you submit, maintained or transmitted by the booking engine. You acknowledge that aa holidays reserves the right to delete accounts that are inactive for an extended period of time. You further acknowledge that aa holidays reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice.

Liability disclaimer
The information, software, products, and services published on aa holidays may include inaccuracies or errors, including pricing errors. In particular, aa holidays and it’s corporate affiliates and the affiliated co-branded and/or linked partners through whom we provide services do not guarantee the accuracy of, and disclaim all liability for any errors or other inaccuracies relating to the information and description of the service provider displayed on this booking engine (including, without limitation, the pricing, photographs, list of amenities, general product descriptions, etc.), much of which information is provided by the respective suppliers. In addition, aa holidays expressly reserves the right to correct any pricing errors on our booking engineAnd/or on pending reservations made under an incorrect price. In such event, we will offer you the opportunity to keep your pending reservation at the correct price or, at your option we will cancel your reservation without penalty.
Establishment ratings displayed on aa holidays are intended as only general guidelines, and aa holidays does not guarantee the accuracy of the ratings. Aa holidays and their respective suppliers make no guarantees about the availability of specific products and services. Aa holidays and its respective suppliers may make improvements and/or changes on this booking engine at any time.
Aa holidays, and its respective suppliers make no representations about the suitability of the information, software, products, and services contained on this booking engine for any purpose, and the inclusion or offering of any products or services on aa holidays does not constitute any endorsement or recommendation of such products or services by aa holidays. All such information, software, products, and services are provided "as is" without warranty of any kind. Aa holidays, and its respective suppliers disclaim all warranties and conditions that this booking engine, its servers or any email sent from aa holidays, and/or its respective suppliers are free of viruses or other harmful components. Aa holidays and its respective suppliers hereby disclaim all warranties and conditions with regard to this information, software, products, and services, including all implied warranties and conditions of merchantability, fitness for a particular purpose, title and noninfringement.

The service providers on this booking engine are independent contractors and not agents or employees of aa holidays. Aa holidays is not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting there from. Aa holidays has no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure or other causes beyond its direct control, and it has no responsibility for any additional expense, omissions, delays, re-routing or acts of any government or authority.
In no event shall aa holidays and/or their respective suppliers be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of, or in any way connected with your access to, display of or use of aa holidays or with the delay or inability to access, display or use this booking engine (including, but not limited to, your reliance upon opinions appearing on this web site; any computer viruses, information, software, linked sites, products, and services obtained through this website; or otherwise arising out of the access to display of or use of this website) whether based on a theory of negligence, contract, delict, strict liability, or otherwise, and even if aa holidays and/or its respective suppliers have been advised of the possibility of such damages.

If, despite the limitation above, aa holidays or their respective suppliers are found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then aa holidays or their respective suppliers liabilities will in no event exceed, in the aggregate, the greater of (a) the transaction fees assessed for your transactions on this booking engine or (b) one hundred rand (zar100). The limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these terms is found to have failed of its essential purpose. The limitations of liability provided in these terms inure to the benefit of aa holidays and/or their respective suppliers.

Indemnification
You agree to defend and indemnify aa holidays and/or their respective suppliers and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of: .
(a) your breach of this agreement or the documents referenced herein;
(b) your violation of any law or the rights of a third party; or
(c) your use of this booking engine.

This booking engine may contain hyperlinks to websites operated by parties other than aa holidays. Such hyperlinks are provided for your reference only. We do not control such websites and are not responsible for their contents or the privacy or other practices of such websites. Further, it is up to you to take precautions to ensure that whatever links you select or software you download (whether from this website or other websites) is free of such items as viruses, worms, trojan horses, defects and other items of a destructive nature. Our inclusion of hyperlinks to such websites does not imply any endorsement of the material on such websites or any association with their operators.

Force majure
Aa holidays does not accept liability or pay you compensation where the performance of our contractual obligations is affected by "force majeure" (included but not limited to war, threat of war, riot, civil or political unrest, industrial dispute, terrorist activity, natural or nuclear disasters, fire, adverse weather conditions, closure of ports or airports, air traffic control delays technical problems, circumstances amounting to "force majeur".
